Migori police officer slapped with a 15 year jail term for defilement

A police constable attached to Rapogi Police Post in Uriri, Sub County was on Tuesday slapped with a 15 year jail term for defiling a minor.

Constable Howard Omwaha, 37, had pleaded not guilty to defilement charges contrary to section 8(1) of the sexual Offences Act No. 3 of 2006 when he appeared before Migori resident magistrate Angela Munyuny in 2021.

He also faced an alternative charge of having an indecent act with a minor, a charge he equally denied.

Court documents seen by KTMN news indicated that the suspect defiled the minor on diverse dates between March 1st and April 30th 2021 before he was arrested and arraigned at Migori law courts.

The officer who had been out on bond was sentenced on August 2023, bringing to a halt the three year legal battle that has seen the aggrieved family get justice.

Reading the deterrent sentence on Tuesday, the presiding magistrate ordered that the suspect be imprisoned for 15 years with an alternative to appeal within 14 days.
