The Kisumu High Court has sentenced Lower Kadongo Assistant Chief Joel Juma Oliewo to 30 years in prison for the murder of Erick Ochieng Atito in Kadawa village, Kisumu West Sub-county.
Delivering the ruling, Justice R.E. Aburili condemned Oliewo’s blatant abuse of power, emphasizing that no public official is above the law.
The court established that on October 7, 2021, Oliewo assaulted and fatally injured Atito in public after accusing him of rape. Instead of following due legal procedures, the assistant chief unlawfully took matters into his own hands, leading to Atito’s tragic death.
Speaking outside the courthouse, Alfred Omondi, the deceased’s brother, welcomed the ruling, describing it as a significant step toward justice.
“This judgment sends a clear message that those in power must act within the law. We commend the court for holding Oliewo accountable,” Omondi stated.
The victim’s family expressed satisfaction with the verdict, terming it a critical milestone in their pursuit of justice.
Oliewo had initially pleaded not guilty on October 27, 2021, following a mental health assessment that confirmed his fitness to stand trial.
The case, which has attracted public attention since 2021, underscores the dangers of unchecked power and highlights the need for strict adherence to due process.
The convict retains the right to appeal the sentence within 14 days.
