A land dispute at Stella Market in Uriri Sub-county, Migori County, has turned tragic after fruit vendor Jamima Mboga died following a shooting that occurred during a confrontation involving a civilian firearm holder and boda-boda operators.
The incident, which began over a disputed piece of land occupied by a newly erected shade, descended into violence after an argument escalated and members of the public gathered at the scene.
Police reports corroborated with witness account indicate that the firearm holder, identified as Alfred Mdeizi, went to the structure claiming that it had been erected on his land.
The shade was being used by boda-boda operators, and the disagreement reportedly attracted a crowd that became increasingly rowdy.
During the ensuing commotion, Mdeizi discharged his firearm, hitting Mboga, a fruit vendor who was at the market, in the upper arm.
The injured woman was rushed to Migori Hospital for treatment. However, her condition deteriorated, and she later succumbed to her injuries on the morning of the 17th, according to the information provided.
Her death has transformed the incident from a shooting investigation into a potentially more serious criminal case, with investigators expected to establish the circumstances surrounding the discharge of the weapon and whether its use was legally justified.
Suspect Rescued From Angry Crowd
The incident also triggered an immediate security challenge as angry youths reportedly turned against the suspected shooter.Police officers intervened to rescue Mudeyi from the agitated crowd, preventing the situation from escalating further.
“He was subsequently taken to Life Care Hospital, where he received treatment for bruises and other injuries allegedly sustained during the confrontation,” noted Uriri Sub-county Police Commander.
Following his discharge, the suspect was placed in police custody as investigators pursued the case.
Authorities later presented him before a court through a miscellaneous application seeking additional time to complete investigations.
Such applications may be used to seek judicial authorisation for additional investigative time or other specified orders, depending on the circumstances of the case.
The court’s decision and any subsequent orders would determine the terms under which investigators could proceed.
The application itself should not be confused with a finding of guilt. With Mboga’s death, investigators face the task of establishing the precise cause of death, reconstructing the sequence of events and determining the circumstances in which the firearm was discharged.
The investigation is also expected to examine the nature of the land dispute, the conduct of those involved in the confrontation and any evidence that may clarify whether the shooting was intentional, reckless or otherwise legally justifiable.
Murder Question Looms Over Investigation
The fatal outcome has raised the possibility of a murder charge against the firearm holder, although the final charge will depend on the evidence gathered by investigators and the decisions of the relevant prosecuting authorities.
Under Kenyan law, murder generally involves causing another person’s death with malice aforethought, as defined under Section 203 of the Penal Code.
The circumstances surrounding a shooting, including the accused person’s actions and state of mind, are relevant to determining the appropriate charge.
A fatal shooting does not, by itself, establish murder. Investigators must establish the facts, while the prosecution must prove the elements of any charge brought before the court.
The question of whether the firearm was used in lawful self-defence or other legally recognised circumstances will therefore require careful examination of the available evidence.
A claim of lawful justification, if raised, would need to be assessed against the facts and applicable law.For now, the suspect remains entitled to the presumption of innocence unless and until a court determines otherwise.
Police Restore Calm at Stella Market
Uriri Sub-county Police Commander Bashir Ali said security officers had restored calm in the Stella Market area following the confrontation.Police deployed officers to prevent further violence, destruction of property and possible retaliatory attacks as tensions mounted over the shooting.
The incident highlights the risks that can arise when disputes over land, trading spaces and public access escalate into confrontations involving weapons and crowds.
Markets are important economic centres where traders, transport operators, customers and other residents interact daily.
A disagreement over the ownership or use of a trading space can quickly affect livelihoods and public safety when it is not addressed through established dispute-resolution mechanisms.
The presence of a firearm in an already volatile confrontation can make an argument far more dangerous, particularly when bystanders are caught in the resulting chaos.
Mboga’s death has consequently left investigators with two related responsibilities: establishing criminal accountability for the fatal shooting and determining the circumstances that allowed a land-related disagreement to spiral into a deadly confrontation.
Police Warn Against Mob Justice
Commander Ali urged members of the public to remain calm and avoid taking the law into their own hands when disputes arise.
He encouraged residents to report grievances to police stations, police posts and relevant administrative offices instead of resorting to violence or attempting to punish suspects themselves.
Police warned that mob action could lead to further injuries, destruction of property and interference with investigations.
As the investigation continues, the circumstances of Mboga’s death, the legality of the firearm’s use and the possible criminal responsibility of those involved remain central questions for investigators and the courts.
For the family of the deceased fruit vendor, the tragedy has brought a devastating loss.
For the Stella Market community, it is a stark reminder of how quickly a dispute over land can turn deadly when anger overtakes lawful processes.
The next stage of the case will depend on the evidence gathered by investigators, the findings concerning the cause of death and the charging decisions made by the relevant authorities.
