The Political Parties Disputes Tribunal has set September 10, 2026, as the date for judgment in a complaint filed by former ODM Secretary General Edwin Sifuna challenging his removal from office.
The decision followed an agreement by the parties to have the matter determined through written submissions filed before the Tribunal.
Sifuna, represented by Senior Counsel Okero, argued that ODM’s National Executive Committee (NEC) acted outside its mandate under Article 74(2) of the party’s Constitution when it initiated his removal.
However, ODM, represented by lawyers Sam Makori, Ken Amondi and Hon. T.J. Kajwang, challenged the Tribunal’s jurisdiction to hear the complaint.
The party argued that Sifuna should have approached the Tribunal through an appeal as provided under Regulation 7 of the Political Parties Disputes Tribunal (Procedure) Regulations, 2017.
ODM further maintained that the NEC acted within the powers granted to it under Article 74(2) of the party Constitution, with the party’s Disciplinary Committee ensuring that due process and procedural fairness were observed.
The Tribunal is now expected to determine both the jurisdictional questions and the substantive challenge when it delivers its judgment on September 10.
