The high court has quashed the election of Migori County assembly speaker Charles Likowa following a successful petition by one of the contenders.
The Monday’s decision follows a similar order by a lower court that nullified Mr Likowa’s election after after mr Isaac Aluochier, and aspirant in the last election challenged the legitimacy of the election.
Mr Likowa and the assembly sought stay orders and pushed through a consensus to have his seat stay, which was set aside on Monday.
“His election was quashed in a judgment last year, on Monday the stay orders was set aside,” Mr Aluochier said in a phone interview.
An attempt at meditation and arbitration also failed, on Monday the court refused to extend the stay orders.
The court gave 21 days for a new election for the next speaker which will fall on March 25.
“I will be in the ballot to again vie as a speaker,” he said.
But already lawyers in the county government are working on seeking fresh orders to quash the judgment with Mr Likowa maintaining that he is still the speaker.
In a seperate interview, Mr Likowa called for calm while shrugging off the court decision which he termed as “mere talk with no basis.”
“Ignore the naysayers, I am the speaker and nobody will shove me aside from this position. We are keen on serving the electorate and no form of intimidation will deter this quest,” he said.
