High Court Issues Conservatory Orders Halting Impeachment of Meru Governor Kawira Mwangaza

In a significant legal development, the High Court has issued conservatory orders suspending the impeachment of Meru Governor Kawira Mwangaza. High Court Judge Bahati Mwamuye ruled in favor of the embattled governor, halting further action on her impeachment by the Senate.

The court’s orders, issued on August 21, 2024, bar the Senate Speaker from declaring Governor Mwangaza’s position vacant. The ruling also blocks Deputy Governor Isaac Mutuma from being gazetted as governor until the court order is vacated.

“Pending the interparty hearing and determination of the Application dated August 21, 2024, a conservatory order be and is hereby issued staying the furtherance of the implementation of the Resolution of the Senate removing the Governor of Meru County, Kawira Mwangaza, from office by way of impeachment,” Justice Mwamuye stated.

This decision comes just a day after the Senate upheld the Meru County Assembly’s impeachment of Mwangaza. She had been found guilty of three charges: gross violation of the Constitution, abuse of office, and gross violation of national and county laws.

During the Senate vote, 26 senators voted to uphold the MCAs’ ouster motion, with four voting against and 14 abstaining.

The High Court’s decision now sets the stage for further legal deliberations, with the case expected to proceed through hearings before a final judgment is rendered. Governor Mwangaza will remain in office pending these proceedings, offering her a temporary reprieve in her fight to retain her position.
